PLEASE READ BEFORE REGISTERING
This Ceramic Studio Liability Release & User Agreement applies to all participants in Mud Lake Studios classes, workshops, studio activities, and other activities.
Please read this agreement carefully before registering.
As part of registration, you will be asked to confirm your agreement to the terms of this document by checking the required acknowledgment boxes and providing your electronic signature.
By completing the required acknowledgments and electronic signature during registration, you are confirming that you have read, understood, and voluntarily agreed to this entire agreement.
If the participant is under 18, a parent or legal guardian must complete the required acknowledgments and electronic signature on behalf of the minor participant.
1. THE ACTIVITIES
Mud Lake Studios provides ceramic classes, workshops, studio activities, and related experiences that may include wheel throwing, handbuilding, sculpting, trimming, carving, decorating, glazing, kiln firing, handling ceramic materials, and use of hand tools, pottery wheels, kilns, and other studio equipment.
Ceramic work may remain at the studio after a class for drying, firing, glazing, cooling, handling, and storage before it is returned to the participant.
2. RISKS OF PARTICIPATION
I understand that participating in ceramic studio activities involves inherent and other risks.
These risks may include, but are not limited to:
Exposure to clay dust, silica-containing materials, glaze materials, stains, chemicals, and other studio substances.
Skin or eye irritation, allergic reactions, respiratory irritation, or other reactions to studio materials.
Cuts, punctures, or other injuries from tools, equipment, sharp edges, broken ceramic pieces, or other objects.
Burns from kilns, hot equipment, kiln shelves, fired ceramic work, or other hot surfaces.
Risks associated with pottery wheels, hand tools, electrical equipment, machinery, shelving, and other studio equipment.
Slips, trips, falls, or other accidents while moving through or working in the studio.
Injury caused by another participant, instructor, employee, visitor, or other person.
Risks associated with lifting, carrying, moving, or handling clay, ceramic work, equipment, or other materials.
Damage to clothing, personal belongings, or other personal property.
Risks associated with drying, firing, glazing, handling, transporting, or storing ceramic work.
Damage to ceramic work caused by the ceramic process, including cracking, warping, breakage, glaze defects, kiln-related incidents, or other unexpected outcomes.
Other risks that may result in property damage, illness, personal injury, serious injury, or death.
I understand that this list is not exhaustive and that other risks may exist.
3. ASSUMPTION OF RISK
I voluntarily choose to participate in Mud Lake Studios activities and knowingly assume the risks associated with my participation.
I understand that some risks are inherent in ceramic studio activities and cannot be completely eliminated without changing the nature of the activity.
I agree to follow all Mud Lake Studios safety instructions, posted rules, equipment instructions, and directions provided by instructors, employees, or representatives.
I understand that Mud Lake Studios may ask me to stop participating in an activity or leave the studio if I fail to follow safety instructions or studio rules or if my conduct creates a safety risk.
4. RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to participate in Mud Lake Studios activities, I voluntarily release and discharge Mud Lake Studios LLC and its owners, members, employees, instructors, agents, representatives, successors, and assigns (collectively, the "Released Parties") from claims for injury, illness, death, or property damage arising from my participation in Mud Lake Studios activities, to the extent permitted by Oregon law, including claims based on ordinary negligence.
I understand that this release means that I may be giving up certain legal rights that I might otherwise have.
I understand and agree that this release applies to activities conducted at Mud Lake Studios and, when applicable, activities conducted at other locations by or on behalf of Mud Lake Studios.
Nothing in this agreement is intended to release, waive, or limit any claim or liability that cannot legally be released, waived, or limited under Oregon law.
5. CERAMIC WORK, FIRING, AND GLAZING
I understand that ceramic work is subject to the normal risks and variables of the ceramic process.
My work may crack, warp, break, explode, collapse, discolor, glaze differently than expected, adhere to kiln shelves, be damaged by another piece, or otherwise be damaged or lost during drying, firing, glazing, handling, transportation, or storage.
I understand that these outcomes may occur even when reasonable care and appropriate studio procedures are used.
I understand that Mud Lake Studios does not guarantee that my ceramic work will survive drying, firing, glazing, handling, or storage, or that it will produce a particular result.
I agree to follow instructor directions regarding clay type, construction, thickness, attachments, glazing, and other factors that may affect the safety or outcome of firing.
I understand that Mud Lake Studios may determine that a piece is unsafe or unsuitable for firing and may decline to fire or glaze that piece when reasonably necessary to protect people, equipment, kilns, or other participants' work.
6. PERSONAL PROPERTY
I understand that I am responsible for my personal belongings and property brought into or left at the studio.
I understand that Mud Lake Studios is not responsible for ordinary loss, damage, deterioration, or theft of personal property, except to the extent liability cannot legally be excluded or limited.
7. HEALTH AND SAFETY
I agree to inform Mud Lake Studios of any condition, limitation, allergy, sensitivity, or other circumstance known to me that could reasonably affect my ability to safely participate in studio activities.
I understand that Mud Lake Studios is not providing medical advice, medical supervision, or medical care.
If I become injured or ill while participating in an activity, I agree to promptly notify a Mud Lake Studios instructor or employee.
8. EMERGENCY MEDICAL ASSISTANCE
If I am injured or become ill during a Mud Lake Studios activity, I authorize Mud Lake Studios personnel to seek or arrange appropriate emergency medical assistance when reasonably necessary, particularly when I cannot reasonably make or communicate that decision myself.
I understand that I am responsible for my own medical expenses and that Mud Lake Studios does not provide medical or accident insurance for participants.
9. STUDIO RULES AND CONDUCT
I agree to comply with all Mud Lake Studios rules, safety procedures, posted warnings, instructor directions, and equipment-use instructions.
I agree to use studio equipment only for its intended purpose and only in the manner instructed by Mud Lake Studios.
I will promptly report unsafe conditions, injuries, spills, damaged equipment, broken ceramic pieces, or other hazards to a Mud Lake Studios instructor or employee.
Mud Lake Studios may remove a participant from an activity or studio premises when reasonably necessary for safety, including when the participant refuses to follow safety instructions or engages in conduct that creates a safety risk.
10. MINOR PARTICIPANTS
If a parent or legal guardian is completing registration on behalf of a participant under 18, the parent or legal guardian confirms that:
They are the participant's parent or legal guardian.
They are authorized to enter into this agreement on the participant's behalf.
They have reviewed this agreement with the participant to the extent appropriate based on the participant's age and understanding.
They consent to the participant's participation in Mud Lake Studios activities.
They understand that the risks described in this agreement apply to the minor participant.
11. ELECTRONIC AGREEMENT
During registration, the participant or parent/legal guardian will be asked to complete the required acknowledgment boxes and provide an electronic signature.
By checking the required acknowledgment boxes and submitting the electronic signature, the participant or parent/legal guardian confirms that:
They have read this entire Ceramic Studio Liability Release & User Agreement.
They understand the risks associated with participating in Mud Lake Studios activities.
They voluntarily agree to the terms of this agreement.
They understand that this agreement includes a release of certain claims, including claims based on ordinary negligence, to the extent permitted by Oregon law.
They understand that they may be giving up certain legal rights by agreeing to this document.
If signing for a minor, they confirm that they are the minor participant's parent or legal guardian and are authorized to sign on the minor's behalf.
The electronic signature and required acknowledgments submitted during registration are intended to evidence the participant's agreement to this document to the extent permitted by applicable law.
12. ENTIRE AGREEMENT AND GOVERNING LAW
This agreement constitutes the agreement between the participant and Mud Lake Studios concerning the subject matter addressed here and supersedes prior oral or written representations concerning that subject matter.
Any amendment to this agreement must be made in writing by Mud Lake Studios.
This agreement shall be governed by the laws of the State of Oregon, except to the extent applicable law requires otherwise.

By completing those acknowledgments and providing your electronic signature, you are confirming that you have read, understood, and voluntarily agreed to this entire Ceramic Studio Liability Release & User Agreement.
